Radio Regulations of the People's Republic of China

Chapter 1 General

Article 1 These regulations are formulated in order to strengthen radio management, maintain the order of airwaves, effectively use radio spectrum resources, and ensure the normal operation of various radio services.

Article 2 The establishment and use of radio stations (stations) and the development, production, import of radio transmitting equipment and non-radio equipment using radiated radio waves within the territory of the People's Republic of China must comply with these regulations.

Article 3 The radio management implements the principles of unified leadership, unified planning, division of labor management, and hierarchical responsibility, and implements the principles of scientific management and promotion of development.

Article 4 The radio frequency spectrum resources belong to the state. The state implements the principles of unified planning, rational development, scientific management, and paid use of radio spectrum.

Article 5 The State encourages the development, utilization and scientific research of radio frequency spectrum resources, and strives to promote advanced technologies and improve the management level.

Units and individuals who have made significant contributions in radio management and scientific research shall be rewarded.

Chapter 2 Management Organizations and Their Responsibilities

Article 6 The national radio regulatory agency is responsible for the nationwide radio management under the leadership of the State Council and the Central Military Commission. Its main responsibilities are:

(1) To formulate guidelines, policies and administrative regulations on radio management;

(2) Formulate radio management regulations;

(3) Responsible for the unified management of radio stations (stations) and frequencies;

(4) Coordinate and handle radio management matters;

(5) To formulate industry standards in radio management;

(6) Organize scientific research in radio management;

(7) Responsible for national radio monitoring work;

(8) Handle matters related to foreign-related radio management in a unified manner.

Article 7 The radio management organization of the People's Liberation Army is responsible for the radio management of the military system. Its main duties are:

(1) Participate in the formulation and implementation of national radio management policies, policies, regulations and rules, and formulate military system radio management methods;

(2) Review and approve the establishment of military system radio stations (stations) and nuclear power station licenses;

(3) Responsible for the planning, allocation and management of military system radio frequencies;

(4) Approving the technical indicators related to radio management for the development, production and sale of military radio equipment and the purchase and import of radio equipment for military systems;

(5) To organize scientific research on military radio management and draft technical standards for military radio management;

(6) Implementing radio supervision and inspection of military systems;

(7) Participate in organizing and coordinating the handling of military-ground radio management matters.

Article 8 The radio management agencies of provinces, autonomous regions, municipalities directly under the Central Government, and municipalities with districts are responsible for the radio management work within the jurisdiction, except for the military system, under the leadership of higher-level radio management agencies and people's governments at the same level.

(1) Implement the principles, policies, regulations and rules of national radio management;

(2) To formulate specific regulations on local radio management;

(3) Coordinate and handle radio management matters within the administrative area;

(4) To review the construction layout and site of radio stations (stations) according to the approval authority, assign the frequency and call sign of radio stations (stations), and licenses for nuclear power stations;

(5) Responsible for radio monitoring in this administrative area.

Article 9 The radio management agencies of the relevant departments of the State Council are responsible for the radio management of this system. Their main duties are:

(1) Implement the guidelines, policies, regulations and rules of national radio management:

(3) To approve the construction layout and station address of the radio stations (stations) of the system, assign the frequency and call sign of the radio stations (stations) of the system, and the license of the nuclear power station according to the authority of the department prescribed by the State Council and the entrustment of the national radio regulatory agency

(4) Other duties entrusted by the national radio regulatory agency.

Article 10 The National Radio Monitoring Center and radio monitoring stations at all levels, the National Radio Spectrum Management Center, and the National Radio Spectrum Management Research Institute respectively undertake radio wave monitoring, technical review, new technology development, and scientific research.

Chapter III Installation and Use of Radio Stations

Article 11 Units and individuals who set up and use radio stations (stations) must submit a written application, go through the procedures for establishing a station, and obtain a radio station license.

Article 12 The establishment and use of radio stations (stations) shall meet the following conditions:

(1) The radio equipment complies with the national technical standards;

(2) The operating personnel are familiar with the relevant regulations on radio management and have corresponding business skills and operating qualifications;

(3) The necessary radio network design conforms to the principle of economic rationality, and the working environment is safe and reliable;

(4) Units or individuals setting up stations (stations) have corresponding management measures.

Article 13 The establishment and use of the following radio stations (stations) shall be reported to the corresponding radio regulatory agency for approval in accordance with this article:

(1) The communication range or service area involves more than two provinces or overseas radio stations (stations), the radio stations (stations) set up and used by the central state organs (including their units directly under Beijing), and others set up for special needs, The radio stations (stations) used shall be examined and approved by the national radio regulatory agency.

(2) Provincial and autonomous radio stations (stations) that communicate or serve across regions within the province and autonomous region. The radio stations (stations) set up and used by the district organs (including the units directly under the people ’s political symbols of the provinces and autonomous regions) shall be examined and approved by the radio management agencies of the provinces and autonomous regions.

Radio stations (stations) that communicate or serve within the municipalities directly under the Central Government shall be examined and approved by the radio administration agencies of the municipalities directly under the Central Government.

(3) Radio stations (stations) that communicate or serve within the city of the district shall be examined and approved by the municipal radio administration agency of the district.

Those who apply for the establishment of fixed radio stations (stations) in accordance with the provisions of the preceding paragraph shall also obtain the consent of their superior business department in advance. The establishment and use of radio stations (stations) for special services shall be entrusted to the relevant ministries of the State Council by the State Radio Regulatory Agency for approval.

Article 14 Standard radio stations (stations) on ships, locomotives, and aircraft must obtain radio licenses and report to the national radio regulatory agency or local radio regulatory agency for the record in accordance with relevant regulations.

Article 15 The establishment of amateur radio stations (stations) shall go through the examination and approval procedures for the establishment of stations (stations) in accordance with the relevant provisions of the State on the management of amateur radio stations (stations).

Article 16 The construction layout and site selection of fixed radio stations (stations) located in urban planning areas must conform to the urban planning and be subject to planning management. The administrative department of city planning shall make unified arrangements) to ensure the necessary working environment for radio stations (stations).

Article 17 The call sign of a radio station is prepared and assigned by the national radio regulatory agency, and assigned by the relevant department of the Serving Academy entrusted by the national radio regulatory agency, local radio regulatory agency, or radio control agency.

The call sign of the radio station assigned by the relevant department of the State Council shall be copied to the radio management agency of the province, autonomous region, or municipality directly under the Central Government for the record.

The call sign of the ship or ship station assigned by the radio management agency shall be copied to the transportation department of the State Council for the record.

Article 18 The radio station license shall be uniformly printed by the state, and shall be issued by the relevant department of the State Council entrusted by the national radio regulatory agency, local radio regulatory agency or the national radio regulatory agency.

Article 19 In case of emergencies that endanger the safety of people's lives and property, radio equipment that has not been approved for use may be temporarily used, but it shall be reported to the radio management agency in a timely manner.

Article 20 After the radio station (station) is approved for use: it shall work in accordance with the approved items, and shall not send or receive signals unrelated to work. If it is indeed necessary to change the project, it must go through the change procedures with the original approval agency.

When a radio station (station) is deactivated or withdrawn, it shall promptly go through the relevant procedures with the original approval agency.

Article 21 Units or individuals using radio stations (stations) must strictly abide by relevant state secrets regulations.

Chapter 4 Frequency Management

Article 22 The national radio regulatory agency shall uniformly allocate and allocate radio frequencies.

National radio regulatory agencies and local radio regulatory agencies assign radio frequencies according to the approval authority for the establishment of stations (stations).

The relevant department of the State Council assigns the frequency bands and frequencies allocated for use by this system, and at the same time copies it to the national radio regulatory agency or relevant local radio regulatory agency for record.

Article 23 The frequency of assignment and use must comply with the national regulations on frequency management.

The frequency of the assignment can be adjusted or withdrawn after consultation with the user.

If the frequency usage period expires and you need to continue to use it, you must go through the renewal procedures.

No unit or individual may transfer frequencies without the approval of the national radio regulatory agency or local radio regulatory agency. It is forbidden to rent or lease frequencies in disguise.

Article 24 When it is necessary to implement radio control due to national security and major tasks, units and individuals with radio transmission equipment and other radio wave radiation equipment within the control area must abide by the relevant regulations.

Article 25 For radio stations (stations) set up according to law, the radio management agency shall protect the frequencies used by it from harmful interference.

To deal with harmful mutual interference of radio frequencies, the principles of out-of-band and in-band, secondary business for primary business, later use for first use, and unplanned use for planning should be followed; in case of special circumstances, the national radio regulatory agency shall coordinate according to specific circumstances ,deal with.

Chapter V Development, Production, Sales and Import of Radio Transmission Equipment

Article 26 The working frequencies and frequency bands required for the development of radio transmission equipment shall comply with the relevant national radio regulations, and shall be reported to the national radio regulatory agency for approval.

Article 27 The operating frequency, frequency band and relevant technical indicators of the radio transmission equipment produced shall comply with the relevant provisions of the relevant national radio regulatory agency and shall be reported to the national radio regulatory agency or local radio regulatory agency for the record.

Article 28 When developing and producing radio transmitting equipment, measures must be taken to effectively suppress radio wave emissions. When conducting an actual launch test, it must be approved by the national radio regulatory agency or the local radio regulatory agency.

Article 29 The working frequency, frequency band and relevant technical indicators of imported radio transmission equipment shall comply with the relevant national radio management regulations and shall be reported to the national radio management agency or the radio management agency of a province, autonomous region or municipality directly under the Central Government for approval.

Article 30 The radio transmission equipment produced and sold by an enterprise must comply with the national technical standards and the laws and regulations on product quality management. The departments in charge of product quality supervision and management of the people's governments at and above the county level shall implement supervision and inspection according to law.

Chapter VI Radio Wave Radiation of Non-radio Equipment

Article 31 Radio wave radiation generated by industry, science, medical equipment, electrified transportation systems, high-voltage power lines and other electrical devices must comply with national regulations and must not cause harmful interference to radio services.

Article 32 Where an engineering facility that generates radio wave radiation may cause harmful interference to radio stations (stations), the location and location of the site shall be determined by the city planning administrative department and the radio management agency through consultation.

Article 33 When non-radio equipment causes harmful interference to radio stations (stations), the owner or user of the equipment must take measures to eliminate them; when they cause harm to the safe operation of aircraft or ships, they must stop using them.

Chapter VII Foreign-related Radio Management

Article 34 Foreign-related matters concerning the allocation, allocation and coordination of radio frequencies, as well as the mutual harmful interference between China's radio stations and overseas radio stations, shall be negotiated with the relevant international organizations or countries and regions by the national radio regulatory agency.

Article 35 Foreign embassies and consulates in China, the United Nations and its specialized agencies, and other representative offices of international organizations with diplomatic privileges in China shall set up and use radio stations (stations) to carry or carry radio equipment for entry. Apply to the national radio regulatory agency for approval.

Other foreign users in China, groups coming to China, merchants and other foreign users set up, use radio stations (stations), carry or carry radio equipment for entry, and shall be reported to the State Radio in advance by the competent business department or reception unit in accordance with the provisions of Article 13 of these Regulations Approved by the regulatory agency or local radio regulatory agency.

Article 36 When using foreign ship (including offshore platform) radio stations, aircraft radio stations, car radio stations, etc. in China, they shall abide by the international treaties concluded or participated by the People ’s Republic of China and the laws, regulations and rules of the People ’s Republic of China.

Article 37 The radio station (station) materials required by the International Telecommunication Union shall be reported to the national radio regulatory agency for processing by the relevant departments.

Article 38 Without the approval of the national radio regulatory agency, foreign organizations or personnel may not use electronic monitoring equipment to conduct radio wave parameter tests within China.

Chapter VIII Radio Monitoring and Supervision and Inspection

Article 39 The National Radio Monitoring Center, the National Radio Monitoring Station, the radio monitoring stations of provinces, autonomous regions, and municipalities directly under the Central Government, and the municipal radio monitoring stations with districts are responsible for monitoring radio signals.

Article 40 The main duties of radio monitoring stations at all levels are:

(1) Monitor whether radio stations (stations) are working in accordance with prescribed procedures and approved projects;

(2) Finding sources of radio interference and unauthorized use of radio stations (stations);

(3) Determination of the main technical indicators of radio equipment;

(4) Detection of radio waves of non-radio equipment such as industry, science, medical treatment, etc.

Article 41 The monitoring station (station) of the relevant department of the State Council is responsible for the radio monitoring, supervision and inspection of this system.

Article 4 + 2 The national radio regulatory agency and local radio regulatory agency shall establish radio management inspectors to supervise and inspect all aspects of radio management.

Relevant departments of the State Council may establish radio management inspectors to supervise and inspect the radio management work of this system.

When the radio management inspectors conduct supervision and inspection within the scope of their powers, the relevant units and individuals shall actively cooperate.

Chapter Nine Penalties

Article 43 For units and individuals who have any of the following behaviors, the national radio regulatory agency or local radio regulatory agency may give warnings, seal or confiscate equipment or confiscation of illegal gains according to their specific circumstances; if the circumstances are serious, they may To impose a fine of more than 1,000 yuan and less than 5,000 yuan or revoke its radio station license:

(1) Setting up and using radio stations (stations) without authorization;

(2) Develop, produce or import radio transmission equipment in violation of the provisions of these regulations;

(3) Interfering with radio services;

(4) Randomly change the approved items, and send and receive signals that are not related to work;

(5) Failure to abide by the relevant regulations on frequency management and lease or transfer frequencies without authorization.

Article 44 Anyone who violates the provisions of these Regulations and causes significant losses to the state, collective or individual shall be liable for compensation according to law; the national radio management agency or local radio management agency shall also pursue or recommend that the relevant department pursue the person directly responsible and the leader of the unit Human administrative responsibility.

Article 45 If a party refuses to accept the penalties imposed by the national radio regulatory agency or local radio regulatory agency, it may apply for reconsideration or bring an administrative lawsuit according to law.

Article 46 Any radio administrator who abuses his powers or neglects his duties shall be given administrative sanctions by his unit or superior organ: it constitutes a crime. Investigate criminal responsibility according to law.

Chapter X Supplementary Provisions

Article 47 The radio management regulations of the Chinese People's Liberation Army (including the militia) shall be formulated separately.

The radio management measures for the civil air defense system shall be formulated separately.

Article 48 The special regulations on radio management of public security organs, Chinese People's Armed Police Forces and national security organs shall be separately formulated by the Ministry of Public Security and the Ministry of National Security in conjunction with the national radio management agency in accordance with these Regulations.

Article 49 These regulations shall come into force on the day of promulgation.
